The Department of Defense (DoD) Indian Incentive Program (IIP) is designed to encourage the use of Indian Organizations, Indian-Owned Economic Enterprises, Alaska Native Corporations and Native Hawaiian Small Business Concerns by providing incentive to prime and sub-tier contractors who subcontract with Indian business establishments.
The Indian Incentive Program allows prime and sub-tier contractors to receive a rebate of 5% of the total amount subcontracted to Indian Organizations, Indian-Owned Economic Enterprise and Native Hawaiian Small Business Concerns. The memorandum generated on July 19, 2011 is to provide guidance for all procurement and non-procurement personnel to assist in complying with the Buy Indian Act (25 U.S.C) and the Federal Acquisition Regulations (FAR) Part 8, Required Sources of Supplies and Services, when purchasing supplies and services.
Although, FAR Part 8 identifies Federal Government required sources for the purchase of supplies and services, Bureau policy (20 BIAM, Section 2) states “that all purchase or contracts be made or entered into with eligible Indian Economic Enterprises to the maximum extent practicable and to contact non-Indian contractors only after it has been determined that there are no eligible Indian Economic Enterprises within the normal competitive area that can fill and are interested in filling the procurement requirement.”Regulators implementing the Act have not been cleared for final publication. Over the years, Indian Affairs has created policy with respect to the use of the Act and that policy is contained within the BIA internal manual, guidance was also created in memorandums dated December 9, 1987, May 5, 1988, and May 8, 1990.
The guidance and sources provided in this memorandum are in compliance with the existing laws and regulations to obtain supplies and services. In determining if a required source meets the Government’s need, Contracting Officers should consider factors such as end-function, delivery date, quantity, shipping point, and cost.
